Vegega and Other Competitors Face Defeat in Trade Secret and False Advertising Legal Battle with Vego Garden
In a decisive victory for fair trade and innovation protection, Vego Garden Inc. has emerged triumphant in its legal battle against Huizhou Green Giant Technology Co., Ltd, and Utopban International Trading Co., Ltd, also known as Vegega, among other parties. This landmark ruling by the United States International Trade Commission (USITC) on March 21, 2024, is a significant Section 337 investigation, setting a precedent for intellectual property rights protection in the gardening industry.
The USITC found Utopban -Vegega violating Section 337 due to unfair competition practices, including misappropriating Vego Garden's proprietary designs and false advertising. Vego Garden and Forever Garden have agreed to a settlement whereby Forever Garden will cease the importation, distribution, marketing, advertising, sale, or other transfers of garden beds manufactured by Green Giant after the Presidential review period.
This decision resulted in issuing a Limited Exclusion Order and Cease and Desist Order against Vegega, effectively banning the importation and sale of infringing raised garden beds in the United States safeguarding Vego Garden's technological innovations and market integrity.
